Uniform Power of Attorney Act, store grand opening, and FAQ Friday too?!


Have you heard the news about the Uniform Power of Attorney Act? The State Bar of Michigan has a lovely breakdown of what’s in the UPOAA, but my favorite part is the sample given right there in the law. Really lets you know what kind of stuff should be included. Of course, it’s better to have an attorney draft your POAs alone or as part of a whole estate plan for your particular situation, but it would be a nice stop-gap if you’re ever in a hurry.

FAQ Friday: As part of our mission in accessibility, this week I’ve been talking a lot with notaries about how to adapt when clients or even we ourselves need adaptive supports. What constitutes a signature? What if it’s hard to hold a pen or stylus? Can notaries help you sign, and if so what’s the process? Section 33 of the Michigan Law on Notarial Acts allows a notary to sign on behalf of someone who:

  • Has presented themselves to have their signature notarized;

  • Physically cannot make a mark (hold a pen in fingers, toes, mouth);

  • Is fully aware, communicative, and consenting;

  • Directs or instructs me to do so on their behalf.

Because Michigan does not currently require training for notaries, so many don’t know this or aren’t comfortable doing so because they don’t understand the process of doing so correctly. Part of the MINA mission on education is making sure notaries can actually serve the public they’re supposed to – not just some of the public, but everyone. (Don’t worry, we’re working on making training mandatory too. Stay tuned for those exciting updates!)
